Are Tier-2's required by law?

If you stored chemicals and/or crude oil during the past year, you may have to file Tier-2 reports. As part of Homeland Security, the Emergency Planning and Community Right-to-Know Act (EPCRA) requires companies to submit an emergency and hazardous chemical inventory each year.

What if I don’t file?

Penalties range from $10,000 to $75,000 per violation/per day. In addition, non-compliance opens the door for citizens to initiate civil actions against the owner.



Is this Federal or State law?

The federal government and most states have Tier-2 filing requirements. Reports are filed with the state, the local emergency planning committees, and with local fire departments.
